Adult Drivers Ed Course Terms of Use

Use of the GD web site: Falsification of documents is a crime and is punishable by law. By registering for the GD course and receiving a Certificate of Completion, STUDENT states that he/she studied all of the material in the GD course, completed all of the quizzes at the end of the chapters, and completed and passed the final examination at the end of the course. If GD discovers that STUDENT has willfully misrepresented himself/herself, has cheated, or has attempted to circumvent the security validation mechanisms, STUDENT will be stopped from taking the course with no refund of the registration fees. STUDENT also may be prosecuted for perjury and other criminal acts.

Charges and Terms of Payment: By registering for the course, a fee in the amount of $36.00 will be charged to STUDENT. This includes access to all educational materials in the course as well as all quizzes and three attempts at passing the final exam. It also includes the price of the Certificate of Completion upon passing the course and the mailing of the certificate via US Mail. However, there will be additional charges for the expedited shipping of the certificate, which will vary based on the type of delivery method selected. All fees must be paid in full before STUDENT begins the course. STUDENT may pay by credit card, check, or money order.

Course Schedule: This course is comprised of 8 chapters and a course summation and final exam (chapter 9) to be completed in 6 hours, at a minimum. This includes a mandatory 30 minutes of break time. Sharon Naim is the Instructor for this course. GD will be available to STUDENT 24 hours a day, 7 days a week. This availability may be affected by circumstances such as, but not limited to: system, site, or connectivity failure over which GD has no control.

Grading and Progress Policy: STUDENT agrees that he/she may not be certified or given credit for the course unless STUDENT scores 70% or higher on the final exam. Alternative testing techniques for students with reading, hearing, or learning handicaps and policies for re-testing students who score less than 70% will be a) a review of material; b) translation, if necessary and possible; and c) re-testing, verbally if necessary. STUDENT will be asked a minimum of 40 content validation questions throughout the course, not including the final exam questions.

Timers: STUDENT is required to spend a minimum amount of time on each chapter of the material, which will be specified in each section and chapter by a page timer. Page timers may not be circumvented by clicking the quit icon. If STUDENT exits the course before the page timer has expired, he/she will not be given credit for the page content.

Cancellation and Refund Policy: If you have not started the course, you may request a full refund at any time. You are considered to have "started the course" after recording your voice biometrics sample after logging into your account for the first time. Once you start the course, however, you must request a full refund within three (3) business days of your enrollment date. If you do not request a refund within this period of time, you may still request a refund minus a $15 penalty surcharge. Additionally, once you start the course, if you do not complete it within 180 days from the date of your enrollment your account will be disabled and you may request a refund minus a $15 penalty surcharge. Completion and Certificate Policy: STUDENT understands that he/she must complete all sections of the course material and pass the final exam with a score of 70% or higher in order to receive his/her Certificate of Completion. GD is prohibited from issuing a certificate of course completion if STUDENT has not met all of the requirements for course completion, and STUDENT should not accept a uniform certificate of course completion under such circumstances.

Hardware and Software Requirements: GD prescribes minimum hardware and software requirements for completing the course. Minimum browser requirements include the use of Microsoft Internet Explorer (MSIE) 7.0 or greater, Netscape version 4.8 or greater, or any other browsers that provide equal or greater functionality. In addition, the browser needs to be equipped with Macromedia Flash Player 6.0 or greater. This plug-in is entirely free and is made available from the GD web site for download and installation. The browsers need to support Java and JavaScript. The minimum hardware required is such that it should be able to support the software configuration described above. The course requires the use of a pointing device such as a mouse. The course requires that the hardware be equipped with speakers or headphones. STUDENT will go through the software evaluation after registration but prior to the start of the course. By accepting this contract, STUDENT acknowledges and understands these computer requirements.

Third-Party Data: The STUDENT agrees to undergo personal identification verification by enrolling in the biometric voice verification system over his or her telephone. In unlikely event the STUDENT is unable to enroll or authenticate using voice password procedure the STUDENT should call GetDefensive.com customer service at 1-800-851-3007. Additionally, the STUDENT agrees to undergo a second form of personal identification prior to taking the final exam by successfully answering 3 out of 5 questions drawn from his or her credit history. This process will not reflect negatively upon STUDENT’S credit history and at no time will GetDefensive.com have access to or store any of STUDENT’S credit history information. If a student is unable to verify his or her identity through Experian, he or she will be required to submit a notarized statement of assurance that includes a copy of STUDENT’S government-issued identification.

Privacy Policy: The information about STUDENT collected by GD is subject to this privacy policy. By disclosing the information to GD, STUDENT agrees to the terms of this privacy policy. GD recognizes the importance of protecting the privacy of its students and visitors to its web site while permitting GD to conduct legitimate business by providing services and information of interest to its students and visitors. The GD privacy policy is stated below:

Collection and Storage of Information: GD will collect certain personal information, including STUDENT’S name, address, e-mail address, telephone number, and other personal information, which will change from time to time, when STUDENT registers for the GD online course. GD maintains this information in its customer database.

Use of Information: This information is used to provide STUDENT with the GD online course as requested; to provide the court with information about STUDENT’S performance; to enable billing and shipping of the Certificate of Completion; to provide STUDENT with information about related products and services; to improve the GD web site; and for systems administration and troubleshooting purposes. GD will not share STUDENT’S personal information with parties outside of its company.

STUDENT’S Rights: STUDENT may review and approve the information collected upon registration in the GD customer database. Upon request, GD will remove that information from its customer database or change/correct personal information that STUDENT states is erroneous.

Security Policy: GD undertakes extensive precautions to ensure the security of STUDENT’S information both online and offline.

Online: Private information entered by STUDENT in the GD registration form (i.e., payment information, social security number) is encrypted and protected by SSL, the finest encryption software available. While on a secure page, the lock icon on the bottom of STUDENT’S web browser will appear in the locked position.

Offline: GD also protects STUDENT’S private information offline. GD limits access to information submitted by STUDENT to employees when needed to perform necessary tasks. All GD employees receive training on the GD privacy and security policies. In addition, the servers on which GD stores STUDENT’S information are maintained in a secure environment.

STUDENT has been furnished a copy of the GD tuition schedule; cancellation and refund policy; and GD regulations pertaining to absence, grading policy, progress, and rules of operation and conduct.

This agreement constitutes the entire contract between GD and STUDENT, and verbal assurances or promises not contained herein shall not bind GD or STUDENT.
